Terms and Conditions

Effective September 2026

Scope

These terms apply to all bookings made through 4Drive Argentina. When you reserve a vehicle via our website, you enter into a contract with us for the advance payment and provision of booking details. The actual rental agreement governing your use of the vehicle is signed directly with the local rental company at the time you collect the vehicle. That agreement sets out the specific terms under which you take possession of the vehicle, including permitted use, insurance coverage, and any excess or deductible amounts.

By completing a booking you confirm that you have read, understood, and accept these terms. We recommend reviewing the rental company's conditions carefully when you collect the vehicle, as those terms will govern your rental period and any incidents that occur during it.

Bookings and the Rental Agreement

Your booking through 4Drive Argentina secures your chosen vehicle, dates, and pickup location. Once your booking is confirmed, you will receive a voucher by email containing all the details needed to collect the vehicle, including the name and contact information of the local rental company, the pickup location, and the terms specific to your booking.

At the time of collection, you will sign a separate rental agreement with the local rental company. That document forms the legal contract for the actual use of the vehicle. The rental company will inspect the vehicle with you and note any existing damage in the agreement. Keep a copy of this document throughout your rental period. Any questions or issues during the rental must be directed to the rental company using the contact details in your voucher.

Advance Payment and Balance

When you complete a booking on our website, you pay a booking advance by credit or debit card online. This advance secures your reservation. The remaining balance is payable when you collect the vehicle. The payment methods accepted for the balance depend on the specific vehicle you have booked and will be stated clearly during the booking process and in your voucher.

Acceptable payment methods for the balance may include credit card, debit card, or cash, as specified for your booking. We do not accept cash payments online. Make sure you bring the necessary payment method to the pickup location. If the rental company does not receive full payment at the time of collection, they may refuse to release the vehicle.

Deposit Conditions

Most rental companies require a deposit at the time of collection. This is a temporary hold or pre-authorisation on a payment card to cover potential damage, traffic fines, or excess charges. The deposit amount and the card type required vary by vehicle and are confirmed in your voucher.

The deposit is not a payment and will be released by the rental company after you return the vehicle, provided there are no outstanding charges. Release times depend on the card issuer and may take several days. Excess or deductible amounts remain applicable according to the rental agreement you sign with the local company, regardless of whether a deposit is required. The two are independent conditions.

If you do not have a credit card, consider raising the limit on your debit card before travel to ensure it can accommodate both the balance payment and any required hold.

Drivers and Documents

The lead driver must present a valid driving licence at pickup. An International Driving Permit is recommended in addition to your home licence. The rental company will verify your documents and confirm that you meet their age and experience requirements. These requirements are set by the rental company and may vary by vehicle.

If you wish to add a second driver, notify the rental company at pickup. This is a paid optional service, and the fee will be charged by the rental company. All drivers must meet the same document and eligibility requirements as the lead driver.

Use of the Vehicle

You must use the vehicle in accordance with the rental agreement signed with the local company. Observe local traffic laws at all times. Urban speed limits are typically 40 km/h on streets and 60 km/h on avenues, with limits of 110 km/h on rural roads and up to 130 km/h on autopistas. Ruta 40 runs roughly 5,000 km along the Andes and includes long gravel sections that require appropriate vehicles and careful driving.

If you intend to cross into Chile, you must obtain written permission from the rental company in advance. This permit must be arranged before you collect the vehicle and cannot be added retrospectively. Driving into Chile without authorisation will breach your rental agreement and void any insurance coverage. Notify us at the time of booking if you require this permit.

Changes and Cancellation

If you need to change your booking dates, pickup location, or vehicle type, contact us as soon as possible at [email protected]. We will do our best to accommodate changes, but availability and additional charges may apply. Cancellation terms are set out in your booking confirmation and depend on how far in advance you cancel.

Late cancellations or failure to collect the vehicle may result in forfeiture of the advance payment. If unforeseen circumstances force you to cancel, contact us immediately so we can assess your situation.

Liability

4Drive Argentina arranges your booking with the local rental company that hands over the car. We are responsible for processing your booking and advance payment. The local rental company is responsible for providing the vehicle, maintaining it, and supporting you during the rental period. Any claims arising from the condition or use of the vehicle, including damage, accidents, or mechanical failure, must be directed to the rental company in the first instance.

We are not liable for delays, cancellations, or changes imposed by the rental company due to circumstances beyond their control, including weather, road closures, or vehicle unavailability. The rental agreement you sign at pickup governs liability for damage, theft, and excess charges.

Complaints

If you experience any issues during your rental, contact the rental company immediately using the details provided in your voucher. Most problems can be resolved quickly on the ground. If you are not satisfied with the outcome, email us at [email protected] with full details of the issue, your booking reference, and any supporting documents or photographs.

We will review your complaint and liaise with the rental company on your behalf. Please allow reasonable time for us to investigate and respond. Complaints submitted months after the rental period may be difficult to resolve due to lack of available evidence.

Governing Law

These terms and conditions are governed by the laws of Argentina. Any disputes arising from your booking or use of our services will be subject to the exclusive jurisdiction of the courts of Argentina. The rental agreement you sign with the local company is also governed by Argentine law.
